Road Accident Fund
The Road Accident Fund was established to compensate road-users for losses (arising from injuries/loss of support) suffered by them whilst travelling on South African roads. The claims may relate to temporary or permanent disability, or to loss of support.
The nature and extent of the injuries will determine whether the claim would be considered by the Road Accident Fund. The Road Accident Fund Act makes provision for the claim requirements, and must be carefully examined to ensure that there is no under-settlement of the claim, nor contraventions in process by the offices of the Road Accident Fund.
In the event that you were the sole cause of the accident, or if you were driving the motor vehicle unlawfully at the time of the accident, your claim will not succeed.
It is always best to engage an attorney to assist in navigating the complexities of these claims (particularly in assessing the quantum of the claim, and in approaching the courts should the Road Accident Fund refuse to compensate).
